Chuck Schumer Hands Republicans the Supreme Court For the Next 30 Years

This column is my opinion but based on facts and history.  Liberals are declaring that the republicans have destroyed the Senate by using the nuclear option.  First, let me inform you of a couple of things.  First, the constitution makes no provision for a filibuster among it’s advise and consent on the nominees of any president.  That rule was written to block George W Bush judgeship appointments.  That was only 2003.  Secondly, neither party has ever filibustered a Supreme Court nominee.  Not until Chuck Schumer.

Chuck Schumer’s decision to filibuster Judge Gorsuch is a fatal blunder.  It will cost the democrats the Supreme Court for at least thirty years.  Let me explain.  Gorsuch has a long and solid reputation as a judge, witnessed by the fact that of his cases that were appealed to a higher court, the upper level judges agreed with Gorsuch 97% of the time.  The American Bar Association gave him the highest score possible and the ABA is a very liberal organization.  Democrats were willing to let him pass through until the far left of the party insisted they resist Gorsuch and because many of them are large donors Schumer gave in.

Gorsuch winning the nomination to the Supreme Court is almost a non event since it has always been known that he would win the vote.  I believe that by fighting the Gorsuch nomination, the democrats have cut the legs out from under themselves.  Over the next 3 1/2 years to 7 1/2 years, Trump could nominate three more justices.  Ginsburg could drop over any minute and Justice Kennedy would like to retire and Justice Thomas could also decide to step down.

The court could end up 6-3 or 7-2 conservatives over liberals.  All of the conservatives are young with the lone exception of Thomas.  It would be a long long time before democrats could win control.

Had they let Gorsuch through easily, they could have made the case (wrongfully) that they allowed a conservative to replace Judge Scalia and Ginsburg’s replacement should be liberal.  The flaw in that is that after the Gorsuch fight, voters will see democrats opposing any candidate who is not a liberal.  Republicans can point to the fact that no democratic president ever nominated a conservative to the court to replace a liberal judge.

Now, Justice Roberts can never screw us over again once we add to out SCOTUS numbers.
