Here Are Pres. Obamas Constitutional Violations Ruled By A Federal Judge

U.S. District Judge Rosemary Collyer struck down the illegal payments Obama authorized to insurance companies in the form of subsidies.  The judge ruled that Obama cannot spend money that has not been appropriated by Congress.  Obama’s lawyers argued that the spending was implied in the bill.  The judge disagreed.

“None of Secretaries’ extra-textual arguments – whether based on economics, ‘unintended’ results, or legislative history – is persuasive.”

The democrats wrote the bill without allowing republicans to participate and their failure to fund provisions included in the bill is no one’s fault but their own.  Liar for Hire, Josh Earnest cried that it is unprecedented for congress to sue the president.  That is true but on the other hand, no president has spent billions of dollars without the Congress appropriating the money.  Using his logic, Charles Ponzi should never have been sent to jail because it was unprecedented for someone to be prosecuted for running a Ponzi scheme.  Obama plans to appeal the ruling.

The ruling will have no immediate impact because the judge stayed the decision pending appeal, which will eventually be decided by the Supreme Court.  Democrats are criticizing republicans for spending a couple of million in taxpayer funds to pay for the lawsuit.  Funny, they don’t object to billions spent every year illegally by Obama.

The Republican-run legislature and the Democratic-run executive branch have had their differences recently. ‘But these are the kind of political disputes that characterize a democracy,’ the president’s chief spokesman said.

‘It’s unfortunate that Republicans have resorted to a taxpayer-funded lawsuit,’ he said, to re-litigate a fight they keep losing. ‘And they’ll lose it again.’

Given the timing of judgement, which came down as he was scheduled to go before the press, Earnest said he had news to make on an appeal. That will come from the Department of Justice, he said.

But he said, ‘We are quite confident in the power of the legal arguments that we are able to make here.’ 

The White House had originally claimed it didn’t need a say-so from Capitol Hill to pay out the cost-sharing subsidies since a section of the law extending tax credits to help poor Americans pay their premiums implied it. 

The bottom line is that Obama has been living a charmed presidency, flaunting the constitution with impunity.  It finally caught up with him.
