[PHOTO] VA Letter Tells Veteran He Is Incompetent, Not Allowed to Possess Guns or Ammunition

The VA sent this letter to a veteran and explains that he is “NOT COMPETENT” for managing his VA purposes, and INCOMPETENT of managing his own VA benefits so someone is being assigned to manage them for him.

The letter continues with saying that his doctor has diagnosed him with PTSD, his INCOMPETENCY means that he is not allowed to own, transport, purchase, or have in his possession any firearms or ammunition. If he is found to be knowingly in violation of the Brady Law, he will be fined and/or imprisoned.

The letter reads as follows:

Dear Mr. Raybourn:

In our letter of November 20, 2013 we told you that we were receiving evidence about your ability to handle your own financial affairs. We finished the review and decided that you are not competent for VA purposes.

What We Decided

The evidence shows that your disability keeps you from ably managing your Department of Veterans Affairs (VA) benefits. Therefore, we will find someone to manage them for you.

We based this decision on information from your doctor, which showed a diagnosis of post traumatic stress disorder (PTSD) and chronic pain.

As we advised you previously, the Brady Handgun Violence Prevention Act prohibits you from purchasing, possessing, receiving or transporting a firearm or ammunition based upon our determination that you are incompetent to handle your VA funds. You may be fined and/or imprisoned if you knowingly violate this law.

You may apply to VA for relief of firearms prohibitions imposed by the law by submitting your request to the address at the top of this letter on the enclosed VA form 21-4138, Statement in Support of Claim. VA will determine whether such relief is warranted.

We have enclosed a copy of our Rating Decision for your review. It provides a detailed explanation about our decision, the evidence considered, and the reasons for our decision.

What You Should Do If You Disagree With Our Decision

If you do not agree with our decision, please download and complete VA Form 21-0958, “Notice of Disagreement.” You can download the form at http://www.va.gov/vaforms or you can call us at 1-800-827-1000. You have one year from the date of this letter to appeal the decision. The enclosed VA Form 4107“Your Rights to Appeal Our Decision”, explains your right to appeal.
