The claim that one attorney from Hunter Biden’s company lied to the court clerk on the phone to get documents removed from the docket could result in fines, the judge warned Hunter Biden’s attorneys.
The warning came from Delaware’s U.S. District Judge Maryellen Noreika the day before a hearing to discuss a plea bargain that would keep the first son out of jail for tax and weapons offenses.
“It appears that the caller misrepresented her identity and who she worked for in an attempt to improperly convince the clerk’s office to remove the amicus materials from the docket,” Noreika said in an order on Tuesday, according to the Daily Mail.
“Therefore, it is hereby ordered that, on or before 9pm today on July 25, 2023, counsel for defendant shall show cause as to why sanctions should not be considered for misrepresentations to the court,” the judge added.
The legal team for House Ways and Means Committee Chairman Jason Smith (R-MO) filed an amicus brief urging the court to “consider” IRS agent whistleblower testimony, arguing that the criminal case against Biden being handled by Delaware’s U.S. Attorney David Weiss has been handled in a way that prevents more serious charges from being brought against him.
Merrick Garland, the attorney general, has disputed accusations of political meddling. The DOJ gave Weiss permission to speak before Congress despite his claims that he had “full authority” to file charges.
The order stated that Biden’s attorneys asserted that the clerk “voluntarily” withdrew the submission from Smith’s legal counsel. Additionally, Biden’s attorneys stated that they were worried about “personal tax information” being public, and a call was sent to ask about having them placed under seal.
Theodore Kittila, Smith’s lawyer, claimed that his staff “immediately contacted the clerk’s office and we were advised that someone contacted the court representing that they worked with my office and that they were requesting the court to remove” their submission from the docket.
“We immediately advised that this was inaccurate. The Clerk’s Office responded that we would need to re-file. We have done so now,” Kittila added.
Despite the fact that the public can already examine the whistleblower testimony to the House Ways and Means Committee with minimal redactions, the judge ordered that the submission be kept under secret until at least the end of business on Wednesday.
A missive from court official Sam Grimes to Smith’s legal team apologized for the “confusion” that followed a call from a “Jessica Bengels” claiming “she worked with Theodore Kittila and it was important the document was removed immediately or they would could file a motion to seal.” The New York Post columnist Miranda Devine posted screenshots of various emails between the camps.
In response to the judge’s ruling, Biden’s attorneys with Latham & Watkins LLP said they had “no idea how the misunderstanding occurred, but our understanding is there was no misrepresentation.” They included an affidavit from Jessica Bengels, a staff member who had earlier in the day spoken with the clerk, in which she denied lying about her involvement with a particular firm.
The court will decide whether to approve or disapprove the plea agreement reached between Biden’s attorneys and the DOJ at the hearing, which is slated to begin at 10 a.m. on Wednesday.
