Barack Obama has announced that he is sending out notices to every school district in America that any school that does not allow boys in the girl’s bathrooms and showers will face an expensive lawsuit from his caliphate. Students will not have to offer any proof that they are transgendered and the schools will be denied the right to even ask any male student using the girl’s restroom if they are transgendered. The notices will be sent out jointly by the Department of Injustice and the Department of Education.
The notice does not have the force of law behind it, but schools cannot afford the long and costly lawsuit used by Obama to extort them into submission. The Obama caliphate is using the Title IX law that states that it is illegal to discriminate on the basis of sex. That’s quite a stretch to use Title IX to justify extortion.
“A school may not require transgender students to use facilities inconsistent with their gender identity or to use individual-user facilities when other students are not required to do so.”
Currently, federal courts have not conclusively settled whether, and to what degree, sex discrimination laws cover matters of gender identity as opposed to physical sex. But the Obama administration appears optimistic that an aggressive approach will succeed, especially after an April court ruling favored a transgender Virginia girls who sued for the right to use a boys’ bathroom.
The letter says that schools must immediately respect a student’s new gender identity as soon as it is declared by their parent or guardian. Schools are not allowed to require that a student provide a medical diagnosis to justify the change, and they also cannot require a student to legally change their gender.
The transgender policy is already being abused, including a man who dressed as a woman so he could spend two hours video taping women in bathroom stalls.
