As the southern border teeters on the verge of anarchy, a federal judge is upending President Joe Biden’s immigration strategy.

Fox News reports that on Thursday night, Judge T. Kent Wetherell II granted a two-week restraining order against the Biden administration.

The decision bans the federal government from implementing a new policy that would release detained illegal immigrants without assigning them a court date or providing a way for officials to follow them.

According to Fox, under the regulation, immigrants would have been required to request a court appearance via mail or schedule an appointment at an ICE office.

The development happened only a few hours before Thursday night at 11:59 p.m., when the Trump administration’s Title 42 policy, which permits the swift removal of illegal immigrants, was set to expire.

According to a statement provided to the Los Angeles Times, Customs and Border Protection asserted that the judge’s decision will result in overcrowding of its immigration detention facilities.

"This is a harmful ruling that will result in unsafe overcrowding at CBP facilities and undercut our ability to efficiently process and remove migrants, and risks creating dangerous conditions for Border Patrol agents and migrants."

According to the Times, defense lawyers for the federal government have argued that if they were not allowed to release illegal immigrants under the program, they would have to imprison as many as 45,000 people by the end of the month.

According to Fox, Border Patrol sectors would have been permitted to “parole” migrants if their custody capacity was exceeded by 125%.

With the repeal of Title 42, a flood of migrants has been drawn to the border between the United States and Mexico in an effort to profit from what they perceive to be lax enforcement of US immigration law.

According to the Times, Judge Wetherell charged that the Biden administration lured illegal immigrants to the border, causing overcrowding in immigration detention facilities.

"this problem is largely one of Defendants’ own making through the adoption an implementation of policies that have encouraged the so-called “irregular migration” that has become fairly regular over the past 2 years," the judge countered.

Despite the tidal surge at the border, the Biden administration has shown some willingness to turn to harder measures, but it has been unable to stop the record-breaking volumes of illegal immigration.

This Monday, the federal government passed a new law banning asylum requests from anyone who chooses not to lodge them in a secure third nation like Mexico.

During his presidency, former President Donald Trump instituted a similar approach.
