In reading the Wikileaks emails, one thing seems to be apparent. Clinton’s aides acted in her interests as they broke the law. Therein lies the problem. Under normal criminal law, you must prove beyond the shadow of the doubt that Clinton gave the orders that led to breaking laws and running a quid pro quo scheme out of the State Department. As enjoyable as it would be to see Huma Abedin, Cheryl Mills and others entering prison, I would rather make sure that Hillary joins them.
What makes RICO so different? RICO stands for Racketeer Influenced and Corrupt Organizations. The law was enacted in order to hold the heads of the five Mafia families to be responsible for whatever the organization does. It was devastating to the leaders of the Mafia and so too, would be devastating to the Clintons. In RICO investigations it’s considered a conspiracy. Huma and Cheryl would face much harsher punishments as well as Podesta and anyone else who helped in the conspiracy.
18 U.S. Code § 1963 – Criminal penalties
(a)Whoever violates any provision of section 1962 of this chapter shall be fined under this title or imprisoned not more than 20 years (or for life if the violation is based on a racketeering activity for which the maximum penalty includes life imprisonment), or both, and shall forfeit to the United States, irrespective of any provision of State law—
(2)any—
(A)
interest in;
(B)
security of;
(C)
claim against; or
(D)
property or contractual right of any kind affording a source of influence over;
any enterprise which the person has established, operated, controlled, conducted, or participated in the conduct of, in violation of section 1962;
In other words, the maximum jail sentence is life and with a conviction all property believed to be part of the criminal enterprise can be seized.
Under normal prosecution, the Clintons can toss their aides under the bus and avoid prison. Of course if Hillary is elected, it all flies out the window.
