[WATCH] Burglar Shot During Home Invasion, Has Filed a Lawsuit Against The Homeowner

(Scroll down for video) A robber who was convicted of burglary, filed a lawsuit against a homeowner for shooting him during a break in, according to court documents in Indiana.

31-year-old David A. Bailey of Albany, filed his lawsuit against 33-year-old David McLaughlin, who fire shots when he discovered the plaintiff running away from his garage.
Both were charged with crimes. Bailey was charged and convicted of burglary while McLaughlin was charged and convicted of criminal recklessness.

McLaughlin fired three shots at Bailey, hitting him in the arm.

McLaughlin was sentenced to serve 60 days in prison and four months of home confinement while Bailey was sentenced to three years of home detention.

In the lawsuit, Bailey claims that the bullet struck him in the back of the arm and pierced an artery, causing serious and permanent damage.

He wants a monetary award sufficient to compensate for all his damages.
