According to POLITICO, Hunter Biden’s lawyer, Chris Clark, threatened the US attorney investigating his client that if his client was charged in the case, the defense would call President Joe Biden to testify, causing a constitutional crisis by pitting the president against his own Department of Justice.
The warning came after news broke that federal prosecutors believed they had enough evidence to charge Hunter Biden with illegally acquiring a handgun while being a drug addict.
“President Biden now unquestionably would be a fact witness for the defense in any criminal trial,” Clark said in a lengthy letter to prosecutors, later adding: “This of all cases justifies neither the spectacle of a sitting President testifying at a criminal trial nor the potential for a resulting Constitutional crisis.”
The development comes as The New York Times reported on Saturday that special counsel David Weiss reportedly altered his mind about the plea agreement that he was willing to allow his office to offer Hunter Biden during the probe.
According to the article, Weiss was initially willing “to forego any prosecution of” Hunter Biden and was near to “agreeing to end the investigation without requiring a guilty plea on any charges” before being hired as special counsel in the case.
Weiss’ stance on the case apparently shifted around the time that two IRS agents came forth as whistleblowers, alleging that they were prevented from furthering the Biden investigation due to pressure from higher-ups at the Department of Justice.
Weiss asked that Hunter Biden plead guilty to two minor tax offenses and enter into a deferred prosecution deal on a weapons charge when the two whistleblowers came forward.
According to the source, Weiss’ decision to ask US Attorney General Merrick Garland to be named special counsel in the case earlier this month was motivated by a number of circumstances. Reasons included giving him more authority to investigate and prosecute, giving him more leverage over Hunter Biden in future negotiations, and the fact that he is now required to produce a report at the conclusion of the investigation, which will allow him to respond to the intense Republican backlash.
